CODE OF PROFESSIONAL PRACTICE FOR THE ARCHITECTURAL PROFESSION

Every architect, as a natural consequence of their professional work, is a representative of the architectural community in the eyes of society. Therefore, in addition to complying with general professional conduct rules, architects must act in accordance with certain ethical principles in order to maintain and enhance the reputation of the architectural profession.

Every architect is obliged to comply with all current laws, regulations, and information related to architecture; all laws, statutes, and regulations concerning the Chamber of Architects; the rules adopted by the General Assembly of the Chamber of Architects; and the decisions of the Chamber of Architects.


RULES OF CONDUCT FOR THE ARCHITECTURAL PROFESSION

  1. Architects shall ensure that their work protects and enhances environmental quality, national and economic resources, and cultural heritage.
  2. Architects shall possess the technical competence necessary to perform their duties and improve construction quality.
  3. Architects shall encourage participation in discussions concerning architecture and the environment in order to safeguard the interests of society and building users.
  4. Architects shall act honorably, reliably, diligently, and independently.
  5. Architects shall work only for fees based on contractual conditions or applicable fee schedules in their country and/or the country where the work is performed. Competition based solely on fees shall not be accepted.
  6. Architects shall act impartially and shall neither propose nor accept discounts, commissions, inducements, or similar arrangements intended to benefit particular groups.
  7. Architects shall respect the trust of their clients and shall not disclose confidential matters without authorization.
  8. Before undertaking any work, architects shall clearly define the scope, responsibilities, fees, possible limitations of liability, and the duration of the agreement.
  9. Architects shall not accept work beyond their level of competence.
  10. Architects shall not delegate their services to another subcontractor without the written consent of the client.
  11. Architects shall not act in a manner that harms another architect. If they become aware that another architect was previously involved with a project, they shall inform that architect before accepting the commission.
  12. Architects shall avoid conflicts of interest and remain impartial in their relations with colleagues, other professionals, contractors, and commercial parties.
  13. Architects shall avoid entering into partnerships with persons who have been expelled from a Chamber, Institute, Council, or similar architectural organization.
  14. Architects shall not make unfair criticisms or publicly disparage another architect or their work. Professional disputes should remain within professional circles. Criticism of a colleague's work must be confined to reasoned and informed discussion or review.

DUTIES AND RIGHTS OF THE ARCHITECT

  1. Architects are subject to the regulations of the Chamber of Architects.
  2. Through the contract, architects are obliged to have their duties clearly defined by the client.
  3. Architects are required to provide clients with all requested information, advice, and expertise throughout the design and construction process.
  4. Architects are bound by a duty of confidentiality toward their clients.
  5. Architects shall refrain from all forms of advertising.
  6. When employing younger colleagues or managing projects, architects shall share their experience and provide opportunities for professional development.
  7. With the client's consent, architects may collaborate with specialists and artists. In such cases, the rights, duties, and responsibilities of each party shall be defined in advance by mutual agreement.
  8. As a general rule, architects direct and coordinate all members of the profession and specialists involved in a project, including those participating in industrialized construction processes.
  9. Architects shall practice under their own name and personal responsibility. Lending or transferring their professional name is prohibited.
  10. Architects may not receive commissions or benefits from third parties beyond their prescribed fees and salaries.

PROFESSIONAL RESPONSIBILITIES OF ARCHITECTS

1. General Responsibilities

1.1

Architects shall continuously strive to improve their professional knowledge and skills in areas relevant to their practice.

1.2

Architects shall continually work toward aesthetic excellence and the improvement of standards in architectural education, research, training, and professional practice.

1.3

Architects shall, where possible, support related arts and contribute to the knowledge and competence of the building industries.

1.4

Architects shall establish appropriate and effective procedures in their offices, including monitoring and evaluation systems, and shall ensure that sufficient qualified and supervised staff are employed.

1.5

When work is carried out on behalf of an architect by an employee or another person under the architect's direct supervision, the architect is responsible for ensuring that the person is competent and appropriately supervised.


2. Responsibilities to Society

2.1

Architects shall respect the values, natural heritage, and cultural heritage of the communities within which they create architectural works and assist in their preservation. They shall strive for the sustainable improvement of the environment and quality of life and shall fully consider the effects of their work on the interests of all who may use or benefit from it.

2.2

Architects shall never present or promote themselves or their professional services in a false, misleading, or deceptive manner.

2.3

Architectural firms shall not represent themselves in a misleading manner.

2.4

Architects shall comply with the law in conducting their professional activities.

2.5

Architects shall comply with the laws and ethical codes of conduct applicable in the countries and jurisdictions where they provide or intend to provide professional services.

2.6

Architects shall participate, where appropriate, in community activities as citizens and professionals and shall support public awareness of architectural issues.


3. Responsibilities to Clients

3.1

Architects shall undertake professional work only when they possess the necessary knowledge and competence and are satisfied that adequate financial and technical resources are available to fulfill their commitments.

3.2

Architects shall perform their professional duties with appropriate skill, care, and diligence.

3.3

Architects shall carry out their work without unnecessary delay and, to the extent within their control, within a reasonable agreed timeframe.

3.4

Architects shall keep clients informed of project progress and any matters affecting the nature or cost of the work.

3.5

Architects shall be responsible for independent professional advice given to clients and shall undertake services only when they and any consultants engaged possess the required qualifications through education, training, or experience.

3.6

Architects shall not undertake professional work without a clear written agreement covering, among other matters:

  • Scope of work;

  • Allocation of responsibilities;

  • Any limitations of liability;

  • Fees or the method of calculating fees;

  • Provisions for termination of the relationship.

3.7

Payments to architects shall consist solely of fees and bonuses specified in a written appointment or employment agreement.

3.8

Architects shall not offer inducements to obtain work.

3.9

Architects shall respect the confidentiality of their clients' affairs and shall not disclose confidential information without prior authorization, except where disclosure is required by a court order or other lawful authority.

3.10

Architects shall disclose to clients, owners, or contractors any significant circumstances known to them that could create a conflict of interest and shall ensure that such conflicts do not prejudice legal rights or impair their professional judgment.


4. Responsibilities to the Profession

4.1

Architects shall conduct their professional activities honestly and fairly.

4.2

Architects shall not enter into partnerships with persons removed from the register of architects for reasons other than their own request or expelled from a recognized architectural organization.

4.3

Architects shall strive to uphold the dignity and integrity of the profession and ensure that the conduct of their representatives and employees meets the same standard.

4.4

Architects shall contribute, as far as possible, to the advancement of knowledge, culture, and education in architecture.


5. Responsibilities to Colleagues

5.1

Architects shall not discriminate on the basis of race, religion, freedom, marital status, or gender.

5.2

Architects shall not use or unfairly benefit from another architect's intellectual work without explicit authorization.

5.3

When acting as independent consultants, architects shall not submit fee proposals unless requested to do so and unless they possess sufficient information regarding the project's nature and scope.

5.4

To protect clients and the public from inadequate professional services, architects shall not alter their fee proposals solely in response to a fee proposal submitted by another architect for the same service.

5.5

Architects shall not attempt to take over another architect's commission.

5.6

Architects shall not participate in any architectural competition that has been declared inappropriate by the UIA or their member organization.

5.7

Architects who have served as jury members in a competition shall not subsequently undertake any role related to that project.

5.8

Architects shall not maliciously or unfairly criticize or attempt to discredit the work of another architect.

5.9

When approached regarding a project or professional service, architects who know, or could reasonably determine, that another architect already has an agreement with the same client concerning that work shall notify the other architect.

5.10

When engaged to provide an opinion on another architect's work, architects shall notify the other architect unless doing so would clearly prejudice pending or future legal proceedings.

5.11

Architects shall provide appropriate working conditions for partners and employees, compensate them fairly, and support their professional development.

5.12

Architects shall ensure that their personal and professional financial affairs are managed lawfully and prudently.

5.13

Architects shall build their professional reputation on the quality of their own services and performance, while recognizing and appropriately valuing the professional contributions of others.
